1. Terms of Use

1. Acceptance of Terms

By downloading, installing, or using InkedOut ("the App"), you agree to these Terms. If you do not agree, please do not use the App.

2. Eligibility

InkedOut is intended for users 18 years of age or older. By using the App, you confirm that you meet this age requirement.

3. Accounts & Security

To use core features, you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. We cannot guarantee that your account will be secure; notify us immediately of any unauthorized access.

4. Software License (EULA)

InkedOut grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You agree not to:

  • Reverse-engineer, decompile, or attempt to extract the source code
  • Modify, adapt, or create derivative works based on the App
  • Use automated systems to scrape or harvest data from the App
  • Resell or redistribute the App or its features

5. User Content & Intellectual Property

Ownership

You retain all rights to the tattoo artwork and images you post. By uploading content, you grant InkedOut a non-exclusive, worldwide license to display, distribute, and promote that content solely to operate and market the App.

Instagram Import

By using the Instagram import feature, you acknowledge that you are importing content from a third-party service. You are responsible for ensuring you have the right to import and display that content.

InkedOut IP

All app design, code, branding, and platform architecture remain the exclusive property of InkedOut.

6. Platform Rules & Conduct

You agree not to use InkedOut to:

  • Harass, threaten, or discriminate against other users
  • Post illegal, hateful, infringing, or explicit content
  • Spam, misrepresent your identity, or attempt to manipulate search/discovery algorithms
  • Use the platform for unsolicited commercial advertising

7. Service Disclaimer

InkedOut is a discovery and communication platform. We do not provide tattooing services, verify artist credentials, or guarantee the quality, safety, or hygiene of any listed professional. Any arrangements, deposits, or services exchanged between users occur entirely at your own risk.

8. Financial Transactions & Payments

Currently, InkedOut does not process payments. When we implement payment or scheduling features in the future, those transactions will be governed by separate merchant terms. We are not a party to any financial agreements between users.

9. Disclaimers & Limitation of Liability

As-Is Service: InkedOut is provided "as is" without warranties of any kind. As a startup in active development, we do not guarantee uninterrupted, error-free, or secure operation.

Liability Cap: To the maximum extent permitted by law, InkedOut shall not be liable for any indirect, incidental, special, or consequential damages (including lost data, profits, or business interruption) arising from your use of the App.

10. Termination

We reserve the right to suspend or terminate your account at any time, without notice, for conduct that violates these Terms or threatens the safety and integrity of our community. Upon termination, your license to use the App ends immediately.

11. Changes to Terms

We may update these Terms periodically. We will notify you of material changes by updating the "Effective Date" or through in-app notification. Continued use constitutes acceptance.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of Utah. Any disputes shall be resolved in the courts located in Utah.

At InkedOut, we respect your privacy and are committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, and protect your data.

1. Information We Collect

A. Information You Provide

When you create an account, we collect:

  • Identity Data: Name, email address, and password.
  • Profile Data: Photos, bio, and tattoo portfolio information.
  • Communication: Messages sent between users or customer support requests.

B. Information from Third Parties (Instagram Import)

To facilitate the import of your portfolio, we integrate with Instagram. When you authorize this connection:

  • We access your Instagram profile information (username, profile photo).
  • We fetch your public posts to display them on your InkedOut profile.
  • You can revoke this access at any time in the app settings.

C. Location Data

To fulfill our core purpose which is connecting you with local artists, we log location searches which can be assumed to be a local area.

  • How it works: We will log searches that may be associated with an account.

D. Usage Data

We collect data on how you use the app (e.g., which artists you view, search terms used) to improve our algorithms and user experience.

2. How We Use Your Information

  • To Facilitate Connections: To match you with tattoo artists based on your location and style preferences.
  • To Display Content: To show your imported portfolio to potential clients.
  • To Improve the App: To analyze usage trends and fix bugs.
  • To Communicate: To send you essential updates (e.g., account verification, policy changes).

3. Sharing Your Information

We do not sell your personal data.

We only share information in the following scenarios:

  • With Other Users: Your profile and portfolio are visible to users searching for artists.
  • Service Providers: We use trusted third-party services (such as cloud hosting, analytics, and Instagram's API) to operate the app. These partners are contractually bound to keep your data secure.
  • Legal Requirements: If required by law or to protect the rights of InkedOut.

4. Data Security

We use industry-standard encryption (SSL/TLS) to protect your data during transmission. We store your password securely using hashing and salting techniques. However, no method of internet transmission is 100% secure, and we cannot guarantee absolute security.

5. Your Rights and Choices

  • Access and Update: You can view and edit your profile information at any time via the app.
  • Delete Account: You may request the deletion of your account and all associated data at any time by contacting us.
  • Photo Permissions: You can use the app without uploading media from your device.

6. Children's Privacy

InkedOut is not intended for individuals under the age of 13 (or the applicable age of consent in your jurisdiction). We do not knowingly collect data from children.

7. Changes to This Policy

We may update this policy from time to time. We will notify you of significant changes by posting the new policy on this page or via email.

3. Community Guidelines

1. Respect the Art & The Artist

Authenticity

Only post your own original work. Do not repost others' work without permission.

Quality

Ensure your portfolio photos are high-resolution and clearly showcase the tattoo work.

No "Spec Work" Requests

Clients, do not ask artists to design or execute tattoos for free ("spec work"). This devalues the artist's time and skill.

No Unsolicited Sales

Do not use the platform to spam clients with external links, other social media accounts, or unrelated services.

2. Professional Conduct

Be Respectful

Treat other users with kindness. Harassment, hate speech, bullying, or discrimination based on race, gender, religion, or orientation will not be tolerated.

Privacy

Do not share personal information (addresses, phone numbers) of other users without their consent.

Appropriate Content

While tattoo art can be graphic, do not post gore, illegal acts, or sexually explicit non-artistic content.

3. Intellectual Property

We respect the rights of creators. If you believe your work has been stolen or misused on InkedOut, please contact us immediately.

We have a zero-tolerance policy for users who repeatedly infringe on copyright.

4. Safety & Security

Meetups

If you meet an artist or client in person, please do so in a public place and use your own judgment regarding safety.

Payments

We are not responsible for any 3rd party payment transactions and cannot assure security.

5. Enforcement

We are committed to maintaining a safe community.

Reporting

If you see content or behavior that violates these guidelines, please use the "Report" button on the profile or post.

Actions

Depending on the severity of the violation, we may:

  • Issue a warning.
  • Remove specific content.
  • Suspend or permanently ban the account.

6. Changes to Guidelines

As InkedOut grows, we may update these guidelines to better serve our community. We will notify users of significant changes.
